Figuring Out What’s Important

 


 

In Publishing News This Week,

 

The news everywhere in publishing was the smackdown given by the judge in the Internet Archive vs The Publishers court case. The centre of which was Internet Archive claiming a controlled digital lending policy of printing a PDF from an Ebook for their patrons was fair use.

There were comments on all sides, Libraries, Publishers, Writers, Lawyers all had opinions often conflicting. In the middle was copyright and who loses out. Libraries have been stung by publishers license demands. Publishers argue that a PDF is just the same as an Ebook and if printed out a paperback. This will be an ongoing wrangle.

 

Meanwhile, the American Library Association has released a report stating the numbers of books banned in the USA in 2022 broke all previous limits. It is sobering reading. If you live in a country that doesn’t have book banning public drives, don’t take this privilege for granted. Libraries closing is another way to ban books from the community. 

 

Also in the news was a Wired article that was little better than a hatchet job on Brandon Sanderson. Brandon graciously defended the writer… but the outrage from other writers and his fans was loud and public. Apparently all Brandon does is write in a very scheduled way. If the writer had problems with Sanderson- how come he owns 17 books written by Brandon?

Esquire writing at the same time as Wired detailed the organisation Brandon has had to put in place since that Kickstarter. 

 

AI was back in the news (surprise) today when many influential tech founders published an open letter asking tech companies to pause their AI training citing the risk to humanity. A media commentator looked at how publishers could license content to AI’s and the potential prices they could charge. 

Kris Rusch has an interesting blog post on AI content being the mediocre level of work instead of purposefully crafted writing, or speaking.

 

Jez Walters has an article on how Bonnier Publishing company has restructured based around enthusiast communities. This is a result of the covid lockdown where their publishing company went to Zoom and now they are staying that way. It’s an interesting article. Bonnier CEO likens it to taking the company back to start up mode. Ground yourself in who you are and be pragmatic.

 

Publishing Trends looks at what makes an audiobook original. That is a book that is published in audio first. This is a different publishing model from the norm but audio companies are seeking out titles they can have exclusively.


Lisa Tener has a great article on protecting yourself from accidental plagiarism. Don’t forget to attribute your notes to who said what. Lisa has some recommended plagiarism trackers to keep on hand.

 

Jane Friedman has a guest post by Carly Watters on What Is Upmarket Fiction. This is a deep dive into that sweet spot between commercial and literary, which everyone wants to inhabit.

Trying To Read The Future



In Publishing News this week…

 

Publishers Weekly reports that advocates, Library Futures, have some new language for laws about eBook licensing for libraries. With judges previously weighing in that publisher eBook contracts for libraries were unfair, this could be a popular lifeline for everyone instead of a lawsuit.

 

Publishing Perspectives has an interesting news item from Nielsen that print publishing was almost back to pre Covid levels in the UK. In their wide ranging report about book sales in 2022 there were other little items of interest, paperbacks are back and so is horror. They also asked everyone where they got their book recommendations from.

 

Everyone has heard of BookTok by now. Have you ever wondered if the influencers get paid for their viral book reviews? Not always and not by the publishers. Vox has an in-depth article on the money behind the viral videos.

 

You have probably seen gift books with the child’s name personalised in it. Mark Williams of The New Publishing Standard writes about a Spanish publisher who is taking it the next step further with AI.

 

Jane Friedman has an ask the editor feature on her popular blog. This week she has a post responding to a memoir writer who is worried about lawsuits.

 

This week Sandra Beckwith decided to play along with a publishing predator and details the elaborate bait and switch tactics they were trying on her. She also details red flags to watch out for.

 

Joanna Penn has a fascinating interview with Joseph Nassise on writing diversification, emerging technologies and multiple streams of income. Joseph is traditionally published but has lots of other writing side gigs.

 

This week one of my favourite writing podcasts – Wish I’d Know Then had an interview with Emilia Rose and Michael Evans. They have started a new subscription platform, Ream.Ink, for writers launching in May. In the episode they talk about how subscriptions can be used to test ideas and enhance the reader journey and the tools they have developed for writers. It is a great interview with lots of tips around managing subscriptions, emails, and content delivery, especially if you want to host your own serial writing.

Recently Written Word Media published and excellent article on How to make a book marketing plan. This is one for the print out and keep file.

 

Anne R Allen has an interesting blog post on writing for the web. Different formats apply. As I was reading it I was struck by the comment that the modern paragraph has been shortened because of the web. If you are a certain age you will remember the rules on paragraphs which feed into essays. Web content has changed the way we read and write now.

Cory Doctorow somehow finds time to write amazing prescient tech thrillers while writing daily longform blogs on how corporates have too much tech power over our lives. Cory has long been a campaigner for freedom from DRM. Because of various DRM issues with Audible’s contract terms he funds and produces his own audiobooks. His latest thriller is set in the world of cryptocurrency. His novels have scenarios that then tend to play out in reality. Keeping an eye on Cory’s work is a way of seeing the future which can give you a heads up in preparing for it.

In Publishing News This Week...


In the continuing saga of being a HarperCollins employee- you strike for 3 months, you get told that HC is settling but reducing their workforce and now you hear that severance is all voluntary for a limited time. Publishers Weekly takes the time to remind readers that this was predicted early this year. (See Februarys blog) If you want a more personal story about why it’s so hard to work in publishing, Electric Literature has an essay on how a living wage has never been a priority in publishing.

 

After last weeks news and then backtrack on cleaning up Roald Dahl to this week examining the role of sensitivity readers. Do we really need them? Canadian reporters explore why the publishing industry is feeling alarmed. Meanwhile, well-known Canadian writer Margaret Atwood has decided that she will write her memoir after all. That’s 80 years well lived.

Anne R Allen has a great post on whether you should fictionalise your life. It’s called Autofiction if you are thinking about it.

 

It’s Bookfair time and on everyone’s lips is AI. The Author’s Guild is being proactive and having their lawyers write clauses for writers and publishers to insert into writing contracts limiting the use of AI and Machine Learning on new work. 

 

Mark Williams highlights a little snippet from Animation Magazine – They are embracing AI and using it to make short animations. This new tech promises fun times ahead. Publishers have you thought about your own IP?

 

Kris Rusch continues to look into AI audio and whether its suitable in the first instance to make their print books accessible. She delves into the contracts and hidden fees and concludes that Google is probably the best player at the moment in this space.

 

Bologna Children’s Book Fair celebrates its 60th year and everyone is happy to be back. The big sellers at the fair…children’s mental health books. The legacy of the covid years.

 

Mattel toy company is moving into books which will be based off their IP. So if you have a hankering to ghost write Barbie fiction or Hot Wheels road trips there is a place for you in the Mattel story world.

 

Earlier in the year I linked to a news article about Adelaide books and the problems they were having. Jane Friedman has a guest post this week from a writer caught up in the mess. How Bad Publishers Hurt Authors. Yes, she checked and she checked it was not a scam… it looked legit. Even the most savvy of writers can be sucked in.

Finding The Words



 In Publishing News,

Remember that court case? Simon and Schuster is still up for sale. Publishers Weekly looks at the corporates who might be tempted.

 

Mark Williams has been doing a bit of sleuthing and he has uncovered some big plans by Storytel for expansion into Africa. Audiobooks could be on the menu before print…or even bookshops.

 

Yesterday I had to admit to my teen that books get banned. She was disbelieving. How can anyone ban a book? It was hard to answer. I was left remembering a local author’s comment when his book was banned in the US. “It did wonders for my sales.” So here are the most banned picture books in the last 2 years. In other banned book news, Tanzania has banned Diary of a Wimpy Kid.

 

There is lots of chat around AI and its use or misuse. Writer Beware has an article on the Findaway Apple clause which is very interesting. There is some confusion about what happens to your book if you ask Findaway to tell Apple you don’t want your book to be part of its machine learning programme. (Narrators rights, see last weeks blog.) Some authors are waiting to see if their books will be pulled from Apple as emails indicate that this is a possibility. 


Chat around the author water cooler (Twitter) indicates that AI is a tool – You get into problems when you outsource your creativity to AI. Don’t fall into the trap of asking AI to generate a book everyone has seen before. Check out the list of overused tropes here. 


Here are a few articles that will get you up to speed on current thinking about AI and creative writing.

How AI can help or hurt your writing- Rachel Thompson has an interesting list of things that AI can help with written by AI. A great breakdown of AI as a tool.

Joanna Penn has a step by step article on how she has used AI when writing and publishing a short story. She has screen shots on all the different steps she used. This goes from ideas to editing to titles to art to using AI’s that we all use in editing. 

If you haven’t noticed, even your email uses AI to generate words or phrases for you so it’s here to stay.

 

Kris Rusch has added another post to her series why writers fail. This one is about learning and taking risks. Sometimes the very thing stopping you from succeeding is the fear of taking the next step.

It’s been a rotten old week down here in New Zealand. A cyclone ripped through the North Island and caused immense damage. Devastation and trauma are almost instant creativity killers. If you are struggling to find emotional calm or space to let creativity flow, you are not alone. Take time out or change your focus to learning or improving your writing craft. As Melinda Szymanik says in her excellent article, Sometimes the good thing you wrote will get its moment at some point down the track. Or maybe it is a step you needed to take to get to the thing that will fit with the publisher's aims. Whatever you do, don't throw it out. And keep going.

To Finish,

Wherever a disaster happens there are acts of heroism. There are many acts of kindness unnoticed, unsung, and often under the radar. The shine of the human spirit in the darkness can be the glimmer that leads another out of a very dark place. We have seen a lot of heroism in the last week both here in NZ and overseas. As writers we need to write and celebrate the little acts of heroism as well as the big ones. Donald Mass has a checklist of other ways to write a hero. 


My thoughts are with the families of the heroes. While their loved one is helping others, their family is backing them up by getting on with their own acts of bravery, coping in a natural disaster without them. Two of our first responders gave their lives. 


Sometimes there are no words.

Surfing The Waves Of Change


 

In Publishing News this week,

 

Recently a publishing industry analyst in America predicted that 2023 would be a year of transition for the publishing industry. Change is scary for a conservative industry. Many big publishers will hang on to old ways of doing business for as long as possible while closing their eyes to the swells gathering momentum, ready to break over their heads. Mark Williams has a quick rundown on what publishers should be preparing for. 

 

Meanwhile in the UK, the BBC reports on Welsh publishers who can no longer absorb rising print and paper costs. Either they stop publishing or they raise prices. What will they do?

 

Over in Germany, RTL Deutschland, owned by Bertelsmann, is responding to the “rapidly changing media landscape” by closing 23 magazines with the loss of over 500 jobs.

 

Publishing Perspectives reports on China’s rapidly declining bookstore sales but there is an upsurge in digital book sales. Once again children’s books are saving the publishers.

 

Around the Indie publishing watercooler, the talk is the rights grab clause appearing in Findaway Audiobooks contract. (Schedule D) Apple is able to use your audiobook to teach its AI voice. ‘Not on,’ scream the writers. However, it’s not the writers who lose out, it’s the narrators. They own the rights to their voice. An article on the problems of voice over artists and AI spells out what is coming.

 

AI isn’t all bad, says David Meerman Scott. He has an interesting article about how he uses the tool to work with articles he has already written. Think of it as a super-fast word processing assistant that can repurpose your own content.

 

Kelley Way has collected the top articles on Intellectual Property from 2022 that appeared on the Writer Fun Zone. If you need a quick refresher on what is your IP and how to use it to your advantage- check out this comprehensive list. 

 

Victoria Strauss has a roundup of last year’s big writing scams, shonky contract clauses and vanity publishers who rip people off. Remember that money flows to the writer. If a publishing company asks for money to print your book…tread very carefully as you run in the other direction. 

 

The Guardian reports that the Women’s Prize Trust is expanding their writing prize to include a new Non Fiction prize.

 

Anne R Allen has a great post on Beta readers. What they are and how to manage them. First, figure out what you want them to focus on when they read your book.

Roz Morris has an interesting article on how easy reading is hard writing. In it she reflects on the writer process and how every writer has their own unique way of coming to grips with a story. Many writers take years to nail down a process that works for them.

Kris Rusch also writes about process in her latest blog post. When the world feels like its falling apart your process can get you through the tough times. When sales drop off, when marketing feels useless. When you slog through the story.

You write the book word by word. And that is all that is needed.

Publishers Behaving Badly – Are they really clueless?

 


In Publishing News this week…

 I was contacted today by a writer notifying me of a new scam… on the surface I saw nothing wrong but the writer pointed out that the agent in question should have never used the words 'payment remittance advice' from a financial controller. 

Now you may think that is so under the radar as to be easily overlooked but the author in question went back to the agent. (Note: You should always do this. Ring them and talk in person.) The agent had clicked on a link and inadvertently installed malware on his computer which then gathered up all his email addresses and used them to contact authors… promising money which the authors clicked on spreading the malware. 

Authors are so poorly paid, of course we are going to click on anything that promises us royalties. 

However, this kind of scam targets the financial affairs of agents and publishers. How many of them have tight controls over who can access their financial accounts… and their authors financial accounts? How secure are they? The author who alerted me to this commented that with everyone having to use 2 factor identification all the time elsewhere it seems absurd that publishers and agents aren’t doing the same to limit peoples access to their own accounts. 


Victoria Strauss of Writer Beware has updated the fake agent scam that hit last year… it seems there are many variations around and this year the scam trend continues. Over Summer I had a fascinating conversation with a bank analyst who told me the biggest banking scams were targeting lawyers who thought they were savvy. Always check up- by phone, not return email. 


Meanwhile Publishers Weekly reports that Adelaide Books who got into hot water when they grew too quickly and fell over when Covid hit is trying to make things right. But it is a cautionary tale which has the Authors Guild spluttering with rage on behalf of the 450 authors involved.

 

Publishing Perspectives has named the main stage speakers for London Book Fair. The usual CEO’s are speaking but the subjects reflect the hot topics in Traditional publishing; copyrights, licensing, sustainability of their business, supply chain woes, along with inclusivity and how to get more eyeballs. I wonder if they will come up with any solutions?

 

Sales numbers are a hot topic if you are a publishing CEO – The latest figures from Nielsen and the Association of American Publishers makes interesting reading or if you’re Mark Williams of The New Publishing Standard only a pointer to what he has worked out is the true figure, which is many billions more than Nielsen and AAP think.

 

With the news this week that Harper Collins is going into mediation with its striking staff – a muted cheer went up among HC authors and agents. Today Harper Collins announced they are laying off 5% of their workforce- OUCH.

 

AI images and the threat to income dominates the artists water cooler talk. Two of the main image suppliers Getty and Shutterstock have formed opposing camps. Shutterstock is partnering with AI and Getty has released a formal statement taking AI to court.

Navigating the Author Life



In Publishing News this week,


The annual writing income surveys from the UK, the US, and Australia all hit the news, leaving authors hot and bothered. For many, it was proof that their unsettled feelings that icebergs were ahead was completely right. Writer incomes have dropped all around the world.


The Guardian published the UK findings and then Joanne Harris explained how this drop would impact the books being published in the future.

Australia had a more rigorous approach with Macquarie University publishing breakdowns over 8 key findings from their survey. The impact of the PLR and the ELR income saving the children’s writers particularly.

Written Word Media took a different approach and looked at the backlist and its impact on writer income. There it was a different story. The bigger the backlist you control the better for your income.


Victoria Strauss of Writer Beware has been looking at scam publishers who contact writers telling them that their backlist can be reissued with only a few changes … just sign here. Beware fishhooks. Victoria details how you can get out of these traps if you find yourself in one.


Kris Rusch has been looking at the judges’ comments on the PRH and Simon and Schuster court case and making some pithy comments of her own on bestsellers. This is an informative read, in light of the author income survey results which came out after Kris had written her article. 

 

Over in Europe, audiobook companies are scrambling to get a bigger share of the market and another audiobook company abandons the unlimited subscription model. Mark Williams of The New Publishing Standard also casts a weather eye on Nextory’s venture into adding News and Magazines to its subscriptions.


With all the stress of the writers' income reports Beth Barany of Writing and Wellness suggests 7 different types of rest that writers need to restore their creativity.
